Magnet Solutions, Inc. (“MagNet”) cares about the privacy of you and your personal information. MagNet provides technology and services to facilitate the streaming and digital transfer of content through its relationships with its clients (“Clients”) and their websites (“Client Websites”) who offer to digitally transmit their content to end users (“you” or “Consumers”). In connection with providing such technology and services, and facilitating such content streaming and transfer, MagNet collects and retains certain information about consumers. This privacy policy lets you know what information MagNet collects and how MagNet may use the information. Since the use of MagNet’s technology and services in any specific instance is governed and controlled by Clients, you should also review the Client Website’s privacy policy. If you choose to engage in a content transmission transaction with any of the Client Websites, such transaction is subject to this Privacy Policy, and you agree to the terms of set forth in this Privacy Policy.
WHAT INFORMATION MAGNET COLLECTS
There are many instances where you may be required to provide your personal information in connection with transactions entered into with a Client Website. The types of information which you may be required to provide, the reasons for the collection and use of such information, and the manner of use of such information is set forth below. By visiting the Client Websites, you affirmatively consent to the collection and use of your data.
RegistrationSome of the Client Websites may require that you register before certain site features relating to the digital transmission of content can be accessed. Registration may require your contact information (such as your name, email address, mailing address, phone number, etc.), demographic information (such as your country, gender, etc.), and profile data (such as your music preferences, entertainment practices, etc). You may be assigned a site username and/or password. For internal purposes, this information may be used in order to communicate with you and provide the services you have requested, and to provide a more personalized experience on the Client Websites.
Newsletters And Other Communications From MagNet
Registered users and customers of Client Websites may receive newsletters, email communications, or communications through other channels for, among other purposes, the promotion and marketing of a product or service from a Client Website, which are supplied by MagNet. A Client Website may also offer you the choice, through MagNet, of whether to receive mailings from others that the Client thinks will be of interest. You can unsubscribe by following instructions that may appear at the end of email communications. Note that in order to keep registered users informed about the operation of a Client Website’s services, MagNet may send emails and announcements that are needed for the proper functioning and administration of the Client Website and services offered by the Client Website through MagNet.
Communications with MagNet MagNet has features where you can submit information to MagNet (such as when contacting MagNet with a question or feedback). MagNet may retain your emails and other information you submit to MagNet for MagNet’s internal purposes, and to help MagNet to serve you better.
MagNet’s technology has features that automatically collect information from Consumers to assist MagNet in creating sites that honor Consumer’s preferences and serve their interests and needs. The information is gathered and stored in log files. This information includes, but is not limited to, Internet Protocol addresses, browser type, Internet Service Provider, referring/exit pages, operating system, date/time stamp and clickstream data. MagNet and MagNet’s Clients may use this information, which does not identify you, in various ways, including, but not limited to, analyzing trends, administering the Client Website, tracking Consumers’ movements around a Client Website and to gather demographic information about the Client Website user base as a whole.
Some Client Websites use cookies, which are small data files containing information about the user that are stored on the user's hard drive. Some cookies are used to make login to Client Websites easier (such as by remembering usernames and passwords). If, however, you prefer not to enable cookies, you may disable them. If you do so, you may be limited in using some of the Client Websites’ features. Cookies can also enable MagNet to track users' movements and target their interests to enhance their experience at Client Websites. MagNet may also collect clickstream data and assign unique identifiers to Consumers for the same purposes. Information obtained with these technologies may be associated with your personal information.
MagNet, or a third-party advertisement server, may also use cookies in connection with targeting Client Website advertisements or promotions to you. Client Websites advertisers and other third parties whose products or services are promoted on Client Websites may also use cookies or other technology. Client Websites Web advertising partners may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement. In this way, ad servers may compile information about where you saw their advertisements and determine which ads are clicked on. This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by Client Websites and MagNet and does not cover the use of cookies by any advertisers. MagNet advises you to check their privacy policies for information about their privacy practices.
MagNet may also gather information such as the date, time, browser type, navigation history, and IP address of all visitors to Client Websites. MagNet uses this information for MagNet’s internal security audit log, trend analysis, and system administration, and to gather broad demographic information about Client Website user bases. MagNet may associate this information with your personal information.
WITH WHOM YOUR INFORMATION IS SHARED
Information may be shared with Clients, including their management and representatives. As with other third parties, MagNet is not responsible for how the Clients handle the data once they receive it. Other than as set forth in this policy, MagNet does not share your personally identifiable information with anyone, apart from those acting as MagNet’s agents in providing MagNet’s services, and which agree to use it only for that purpose and to keep the information secure and confidential. Also, please be aware that Magnet’s subsidiaries and affiliated companies and websites, entities into which MagNet and/or its affiliates may be merged, or entities to which any of MagNet’s assets, products, Clients or operations may be transferred, may obtain from MagNet and be able to use your personal information. MagNet will also disclose information MagNet maintains when required to do so by law, for example, in response to a court order or a subpoena or other legal obligation, in response to a law enforcement agency's request, or in special cases when MagNet has reason to believe that disclosing this information is necessary or required to identify, contact or bring legal action against someone who may be causing injury to, or interference with, (either intentionally or unintentionally) MagNet’s, Clients’, or a third party’s rights or property. You should also be aware that courts of equity, such as U.S. Bankruptcy Courts, may have the authority under certain circumstances to permit your information to be shared or transferred to third parties without your permission.
MagNet may share (provide and receive) aggregate information, which is not personally identifiable, with others. This information may include demographic data such as the gender and/or geographic location of groups of users, but it will not include personal information (such as your name or email address). MagNet may use aggregate demographic information about Clients’ consumers in order to improve MagNet’s service, for research purposes, marketing/promotional purposes and/or for industry reporting purposes, among others.
By accepting this Privacy Policy, you expressly choose to receive certain communications from MagNet and third parties at the direction of Clients, and you expressly agree to the privacy practices described herein. You may change your privacy preferences, e.g. choose to cease receiving certain communications from MagNet, by informing a Client of your new preferences. MagNet will be able to honor your new preferences most quickly if you inform the Client of them by following the appropriate instructions in any communication you receive. Please be aware that any such messages you receive through SMS and instant messaging systems (and other systems apart from email) may not include an option to cease receiving communications; to change your privacy preferences with respect to those communications, please go to the profile page at the Client Website where you provided your personal information or direct your instructions to the contact identified at the Client Website or the end of this Privacy Policy.
If a Consumer’s personally identifiable information changes (such as zip code), MagNet endeavors to provide a way to correct or update that Consumer’s personal data. MagNet strives to comply with the Children's Online Privacy Protection Act (COPPA). MagNet does not knowingly collect personal information from U.S. children under 13 without appropriate parental notice and consent. Client Websites that are directed to children where personal information is collected should have a Children's Privacy Policy setting forth the Client Website’s COPPA-compliant practices. Magnet actively attempts to screen-out children from data collection and/or use of interactive or community features. MagNet is committed to protecting children's privacy.

SECURITY
Security for all personally identifiable information is extremely important to MagNet. MagNet stores your personal information securely, and use special procedures designed to protect the information MagNet collects from loss, misuse, unauthorized access or disclosure, alteration or destruction. MagNet restricts access to member information to those employees of MagNet or Client who need access to perform their job functions, such as MagNet’s customer service personnel and technical staff. Please note that MagNet cannot guarantee the security of member account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of member information at any time. For any additional information about the security measures MagNet uses, please contact MagNet at the contact identified at the end of this Privacy Policy or the Client Website.
Many Client Websites make available certain items for purchase. In order to complete purchases made on such website, MagNet may collect billing address and credit card information (such as account name, number and expiration date). This information is used for billing purposes only and is not otherwise shared. In the future, the Client Websites may also feature special purchases or product offerings which link to a number of other third-party store sites and those stores may collect and use your personal information and credit information to process your order subject to their own privacy policies. MagNet is not responsible for the privacy policies of those other websites and advises you to check their policies and terms and conditions as they may vary.
MagNet may provide links to non-Client Websites. MagNet is not responsible for those other sites, their privacy policies or how they treat information about their users, and MagNet advises you to check their privacy policies.
MagNet reserve the right to modify, alter or otherwise update this Privacy Policy at any time, so MagNet encourages you to review this Privacy Policy from time to time. If MagNet makes changes, MagNet will post them MagNet’s website to make users aware of what the changes are so users will always be aware of what information MagNet collects, how Magnet uses it, and when MagNet may disclose it. A User is bound by any minor changes to the policy when she or he uses the site after those changes have been posted. If, however, MagNet is going to use a Consumer’s personally identifiable information in a manner materially different from that stated at the time of collection, MagNet will notify by posting a notice on MagNet’s website for 30 days prior to the effectiveness of any such changes.
If you choose to engage in any transaction with a Client Website which is facilitated by MagNet, any disputes regarding the collection and use of information in connection with such transaction, shall be subject to the terms of this Privacy Policy.
